All citizens have a Fourth Amendment right against unlawful searches and seizures to keep us secure in our property and our person against over zealous police officers.

One of the main areas that this is implicated is in stop and search in a vehicle. Officers use this tactic to contact is many people as possible on the side of the road where there is a lesser burden on them to effect that stop.

But you should be free from unlawful searches and seizures unless there is some type of reasonable suspicion to stop you, and then, probable cause to search or arrest you.

This is one of the areas of the law that police officers go across that line more often than not. And it’s important that we have strong judicial officers– judges– who will review these stops and suppress the evidence when it shows that it is not a legal stop.
